California's Sexual Harassment Training Law (AB 1825) Final AB 1825 Regulations Approved (Aug. 2007) WHO IS COVERED? Any business or enterprise in California that employs 50 or more employees, independent contractors or temporary workers, and/or any California city, county or municipal entity regardless of the number of employees must comply with this law. The 50-person requirement does not mean that all 50 people need to be located in California. However, the supervisory employees that need to be trained are those supervisors who are located in California. The law requires two hours of training every two years. The deadline for the first round of AB 1825 training was January 1, 2006. Thereafter, employers must provide “two hours” of sexual harassment training to each supervisory employee, every two years. The law requires training new and promoted supervisors within 6 months. New supervisory employees must be trained within six months of their assumption of a supervisory position, and thereafter, every two years. The law requires the training to be high quality. According to the text of the law, the training must be of a high quality, conducted via "classroom or other effective interactive training" and must include the following topics: Information and practical guidance regarding federal and state statutory laws about sexual harassment;Regardless of the training method, the training must include questions to assess learning, skill-building activities that assess the supervisor's application and understanding of content learned, and numerous hypothetical scenarios about harassment with discussion questions for the supervisor. WHAT IS THE DURATION OF THE TRAINING? The training does not need to be completed in 2 consecutive hours. For classroom training or webinars, the minimum duration of a training segment shall be no less than 30 minutes. E-learning courses may include bookmarking features which allow a supervisor to pause their individual training so long as the actual e-learning program is two hours. WHAT IS THE FREQUENCY/TRACKING OF THE TRAINING? An employer must train its supervisors once every two years. Moreover, newly hired or newly promoted supervisors shall be trained within six months of assuming their supervisory position and thereafter, shall be trained once every two years. Employers may track training individually, i.e., two years from the date of the individual supervisor's last training, or by training year, wherein the employer designates a "training year" in which it trains its supervisory employees and then must retrain these supervisors by the end of the next training year, two years later. For example, supervisors trained in 2005 must be retrained again in 2007. WHAT TYPE OF TRAINING DOES THE HR MATRIX PROVIDE? We customize our harassment training to the client’s unique industry.
